Why
consider mediation?
People
in conflict consider that their goals clash with the other, and
that there are insufficient resources to satisfy all sides.
Often, with a guide, each party can present their needs in a way
that is heard and understood. They move from domination, avoidance
or manipulation to negotiation.
The parties focus their negotiations based on their needs instead
of emotions or positions.
Parties generally have a higher level of satisfaction with their
mediated outcome.
Agreements last longer, and are easier to review and amend.
Mediation can be considerably less expensive than litigation.

What
is mediation?
Mediation is a guided negotiation.
Your mediator is your guide.
A healthy mediation is where the sides communicate their differences
in a fair way to each other, identify common areas, and work vigorously
towards a resolution of their issues.
A mediator does not take sides or pick a winner. Instead, the mediator
assists the parties so they reach an acceptable agreement without
needing a courtroom.
A good mediator helps the parties negotiate, but does not replace
a lawyer. Each party is encouraged to use a lawyer for advice.
Parties to a mediation often attend with legal counsel so they can
advance the conflict resolution exercise to the best possible resolution.

Getting
going...
Invite
the other side to mediation.
Perhaps give them a brochure or this web site address.
Arrange a no-cost initial discussion with Wayne Plenert
and discuss how mediation might help. Make sure you review fees
and how best to proceed. Each mediation includes an agreement about
the mediation signed by each side and the Mediator.
Wayne is willing to introduce these ideas to the other
side.
The
location is up to you.
We can find office space near to you, or we can attend somewhere
that is easier for both sides.
Fair negotiation requires that information is shared.
Expect that each side will have to disclose all relevant
documents, records and information to the other side, preferably
before the mediation starts.
A customized approach, but with rules.
While each mediation is unique, and will be treated
as an important individual exercise, we always follow the rules
established in British Columbia that set out how those who are lawyers
are to act as mediators.
